BUILDING DEFECTS AND OTHER MATTERS

 

The inspector will be concerned to find any reports or quotations within the records that may relate to building defects or serious maintenance issues. Sometimes there is nothing more than mention of a problem in the minutes of a meeting, with no further mention to indicate whether or not the problem was resolved.


A purchaser should carefully read this section of the report and be aware of the implications of expensive repairs or rectification works on the level of levies. Whether or not this is a serious issue for the purchaser may depend upon the level of funds the owners corporation has put aside to do any required work. The purchaser’s solicitor will be able to advise whether there is any prospect of the owners corporation being compensated via an insurance claim or action against the builder or a builder’s consultant. That may even be a matter dealt with in the owners corporation’s records, in which event the inspector will make a notation in the report.


It is worth noting that the best protection against building defects and serious maintenance issues is an inspection and report from a competent building consultant. These can be expensive but should be seriously considered if there is any concern about the state of the building or community.
